Federal Court Orders Freedom of Abrego Garcia from ICE Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The situation stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in federal detention.
In her decision, the court noted that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
